Damn right. The campaign polled on the issue and Massachusetts residents were strongly opposed to civilian trials for terrorists. On the related issue of closing Gitmo and buying Thomson:During the campaign, Brown repeatedly railed against criminal trials for terrorism suspects, took out a television ad opposing giving “rights to terrorists who want to harm us” and declared that he did not view water-boarding as torture. And in his nationally televised victory speech Tuesday night, the senator-elect seized on the issue again.
“I believe that our Constitution and laws exist to protect this nation - they do not grant rights and privileges to enemies in wartime,” Brown said. “In dealing with terrorists, our tax dollars should pay for weapons to stop them, not lawyers to defend them.”
However, Obama’s plan to buy an Illinois state prison for use as a detention facility and site for military trials of some Guantanamo prisoners will require Congress to appropriate $150 million or more. White House officials have also said they want Congress to change current law so that some prisoners could be brought to the U.S. for indefinite detention without trial, if necessary.A higher level of scrutiny would be in order. The more we learn, the worse it gets.Some analysts said that even before Brown’s victory Obama needed the equivalent of a triple-bank-shot to get Congress to agree to such moves. Now, they said, it could be all but impossible.
“This is a game changer. I think all this stuff is up in the air,” said Bill Martel, a professor of international security studies at Tufts University in Medford, Mass. “My sense is this is an issue of tremendous political vulnerability for the White House and I think what Brown and other Republicans are signaling to the White House is this is going to require a higher level of scrutiny. …Operating under the assumption that we use the status-quo policy, it’s going to be very hard to accomplish what the White House wants to accomplish.”
